Introduction​

Welcome to Tesmon LLC ("Tesmon," "we," "us," or "our"). Our software as a service (SaaS) product is provided to you subject to the following Terms of Service, which may be updated by us from time to time without notice to you. By accessing and using our website tesmon.io and our services, you accept and agree to be bound by the terms and provision of this agreement.

Use of Our Service​

Tesmon provides a SaaS product designed for users across the globe. Our service allows users to leverage various features for personal and professional use, subject to the terms of this agreement.

Account Registration​

You may be required to register with Tesmon to access certain services. When you register, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

Acceptable Use​

You agree not to use the service to:

  • Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Harm minors in any way.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the service.

Intellectual Property Rights​

The service and its original content, features, and functionality are and will remain the exclusive property of Tesmon LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tesmon LLC.

Termination​

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use the service will immediately cease.

Limitation of Liability​

In no event shall Tesmon LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law​

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Changes​

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
